GENERAL CONDITIONS OF SALES
ARTICLE 1: SCOPE
The present general sales conditions are applicable to all orders made on the website www.porcelaineservice.com managed by the company WEB-MARKETING. The simple act of passing an order implies the application of these general sales conditions is accepted entirely and without reserve. WEB-MARKETING reserves the right to modify or adapt at any time these general sales conditions. In the case of modification, for each order, the general sales conditions that were in force the moment the order was placed will be applied.
ARTICLE 2 : PRODUCTS
The texts and photographs illustrating the products are not contractual.
The product offers are proposed within the limit of stock availability. In case of unavailability, the vendor will inform the client as soon as possible. The client can cancel or modify his order. In the case of cancellation, WEB-MARKETING promises to reimburse any payment that has already been made.
ARTICLE 3: ORDER VALIDATION AND ELECTRONIC SIGNATURES (Law of March 13th 2000)
All orders signed by the consumer on our website by a "double-click" constitutes an irrevocable acceptation which can not be called into question within the limits stated by the present general sales conditions.
The "double click" associated to the authentication procedure and the non repudiation and the procedure of the integrity of messages constitutes an electronic signature. This signature has the same value between each party as a manuscript signature.
ARTICLE 4: PRICES AND TERMS OF PAYMENTS
The prices indicated on the site include tax but not delivery charges. WEB-MARKETING reserves the right to modify the price at any time but commits to applying the tariffs in force at the moment the order is made.
The client can make the payment:
- By debit card: this is doing using the secure bank server of the Caisse d'Epargne. This implies that no bank information concerning the client is transmitted via the site www.porcelaineservice.com. The payment by debit card is therefore perfectly secure.
- By cheque or bank transfer: the order will be prepared on reception of payment and after validation. The order will be cancelled if payment is not recorded after 7 days following the placement of the order.
ARTICLE 5: DELIVERY AND TRANSPORT
- Delivery time: WEB-MARKETING commits to delivering orders to the delivery address indicated on the order form within 4 working days from the validation of the order (except weekends and public holidays. The date of validation of the order corresponds to: - The date of the order if payment made by debit card – The date a cheque clears or bank transfer if these modes of payment are used. The times indicated are the average delivery times for deliveries in metropolitan France (except Corsica). Any eventual delay cannot lead to any cancellation of the order, nor eventual compensation.
- Export and sales outside of metropolitan France: In the case of an order to a country other than metropolitan France, the client is therefore considered to be the importer of the products concerned. For products dispatched outside of the EU and DOM TOM, the price is calculated without tax on the invoice. Customs charges and other local taxes are susceptible to be demanded. These charges and their total will be made to the client who holds entire responsibility for their declaration, as for the payment to the authorities of the country concerned, and it is therefore up to the client to inform himself with the authorities concerned.
- Reception and complaints : It lies with the client receiving the parcel to verify the state of the parce land goods and to state any comments if needed on the transport receipts and to confirm any complaints to WEB-MARKETING in writing by recorded delivery within the 48 hours following delivery to the following address:

- Right of retraction: Conform to the article L121-6 and according to the consumer codes, the private consumer who has ordered on www.porcelaineservice.com has 7 working days from the delivery date of his order to return it completely or the part which does not suit him and to request an exchange or reimbursement without penalisation excepting the return delivery charges. Before returning the product, he should seek the agreement of WEB-MARKETING. The product must be returned in perfect state, in the original packaging and undamaged. The return delivery charges, in the case of retraction, rest at the charge of the client. Under no circumstances can the company be held responsible for the return modalities chosen by the client.
- Obligation limits of WEB-MARKETING: The obligations of the company will be fully suspended and shall hold no responsibility in case of events such as: strike, fire, flood, war, riots, requisition, authority reduction of imports and exports, delays of goods transportation as well as all other circumstances independent of our control or of our suppliers after conclusion of the contract, preventing execution in a normal time limit.
ARTICLE 6: LAW AND FREEDOM
Conform to the law of January 6 1978, the client disposes of a right of access, of modification, of modification and of suppression of the personal details which concern him.
